China is set to become a member of the Hague Apostille Convention on November 7, 2023. From that date onwards, if you’re looking to apostille your documents for use in China, a state apostille will suffice. For U.S. Federal documents, the apostille issued by the US Department of State will also be adequate, eliminating the need for China Embassy or Consulate legalization services.
This move comes after China officially joined the Convention of 5 October 1961 Abolishing the Requirement of Legalization for Foreign Public Documents, commonly known as the “Apostille Convention,” on March 8, 2022. The accession streamlines the process for companies and individuals, as foreign documents destined for China will no longer have to undergo multiple rounds of authentication through various authorities, also known as the Legalization Process.
An Apostille is essentially a specialized certificate issued by the Secretary of State, attached to the original document to verify its legitimacy and authenticity. This ensures acceptance in countries that are members of the Hague Apostille Convention.
In the United States, all 50 states, the District of Columbia, and the Federal Government (US Department of State – Office of Authentication) are authorized to issue an Apostille. As of November 7, 2023, with China joining the Hague Apostille Convention, any official document intended for China will require an apostille from the Secretary of State’s office.
